What types of personal data are processed?

Common personal data are processed, such as, for example: personal details (name, surname); contact details (email address, telephone number and mobile number) and data relating to purchases.

For what purposes are personal data processed?

The Data Controller processes your personal data collected during your use of the website and its functions, including through free and optional activities carried out by you. It may process your personal data in the following cases:

  • To allow you to use the website and its functions
  • To respond to your requests and to manage your orders
  • To communicate with you both information relating to the purchase, and to offer you similar and new products and/or services
  • For handling complaints and any disputes
  • To comply with legal obligations
  • To provide you with personalized suggestions and personalize your experience on the website

What is the legal basis for processing?

Gensan s.r.l. processes personal data only to the extent strictly necessary for carrying out its commercial activity, excluding processing when the pursued purposes can be achieved through anonymous data or methods that allow identification of the data subject only when necessary.

 In particular, the data processing purposes are exclusively linked to:

-the online sales service, to allow the correct execution resulting from the sales contract for pre-contractual or post-contractual activities, including pre- or post-sales assistance service;

-your requests for information about our products;

-the management of invoicing and other administrative or accounting practices related to the services provided by Gensan s.r.l.;

- your participation in a contest or event promoted by Gensan s.r.l.

The legal basis for this purpose is Article 6.1, letter b of European Regulation 2016/679. 

Data may also be processed, even without the consent of the data subject, for legal compliance pursuant to Article 6.1, letter c of European Regulation 2016/679 or to ascertain, exercise or defend a right in court, pursuant to Article 9.2, letter f of European Regulation 2016/679 or to carry out statistics on the use of the website and verify its functionality pursuant to Article 6.1, letter f of European Regulation 2016/679.

 

Further purposes: marketing and profiling

With your consent, Gensan s.r.l may process your personal data (personal details, contact details and optionally provided data relating to purchase preferences) to send you newsletters or promotional communications and exclusive events reserved for Gensan s.r.l. Customers.

These marketing activities may be carried out via email, digital platforms or by sharing your personal data with digital platforms and social networks, as part of campaigns such as "Custom Audience CRM". In this way, you may find Gensan s.r.l. advertisements in the spaces on the pages of digital platforms.

 The legal basis for this purpose is Article 6.1, letter a of European Regulation 2016/679, i.e., your consent. 

You may revoke your previously given consent at any time by writing to info@gensan.com.

Furthermore, pursuant to Article 130, paragraph 4 of Legislative Decree 196/2003, as amended by Legislative Decree 101/2018 and in compliance with European Regulation 2016/679, Gensan s.r.l. may use the email address you provided when purchasing one of our products to offer you products similar to those you have already purchased (so-called "soft spam"). However, if you no longer wish to receive such communications, you may notify Gensan s.r.l. at any time using the link on the email communications you receive.

In such an event, no further commercial communications will be forwarded to you by Gensan s.r.l. 

Profiling and marketing activities may also be carried out based on the cookies used on the Website, as specified below. The legal basis for processing is your consent given by accepting the cookies present on the Website (for more information, please consult the Cookie Policy). This consent can always be revoked through the settings relating to cookies, as indicated in the Cookie Policy. Regarding interaction with Social Pages, if you have given your consent to the use of profiling cookies on the Website, Gensan s.r.l. may also process your contact data, in particular your email address and the data communicated by the user during interaction with the Social Pages, to show the user marketing ads and content consistent with your interests, based on the preferences and consumption habits identified through cookies and/or other tracking systems of social media managers, including Meta Platforms Ireland Ltd. ("Meta") and/or as a result of the analysis that social media themselves carry out on their users. In particular, we can show relevant marketing content and advertising based on your interests via digital platforms, information about which preferences and interests, as well as consumption habits, have been acquired: (a) following profiling activity carried out on the Gensan s.r.l. Website and shared (also via API) with digital platforms, including Meta; or (b) based on the correspondence between the preferences and interests expressed by the user who visited the Website and accepted profiling cookies and the user cluster identified by the digital platform (e.g., retargeting); (c) using the targeting tools made available by digital platforms, including Meta, defining the target of users potentially interested in Gensan s.r.l. products and addressing digital platforms to disseminate advertising messages to their users that match the defined target. In the event that you interact with that advertisement, such interaction may be evaluated for the effectiveness of the campaign itself, if you have accepted the use of tracking tools, such as, for example, the Meta Pixel, installed on the Website, through the cookie management tools (e.g., prospecting).

Is the provision of data mandatory or optional and what are the consequences in case of a refusal to respond?

You are free to provide the personal data requested in the application forms for the purchase of products or services included on the website; however, failure to provide the mandatory data and/or consent will make it impossible to obtain the desired product or service.

We also specify that the provision of your personal data for the marketing purposes indicated above is optional and any refusal will not have any consequence on the possibility of purchasing Gensan s.r.l. products, receiving the requested information, products and/or services.

 

To whom are the data communicated?

Personal data may be communicated to third parties, including outside the European Union, through the use of transfer mechanisms deemed appropriate by Chapter V of European Regulation 2016/679.

The data may be transmitted to:

  • software supply, development and information system analysis companies;
  • companies that provide transmission and transport services for communications;
  • authorities and supervisory and control bodies in compliance with legal obligations, regulations and community regulations;
  • controlled companies and affiliated companies;
  • payment systems.

How long are the data stored?

Gensan s.r.l. retains your personal data only for the time necessary to achieve the purposes expressed above. Personal data that are no longer necessary are deleted or anonymized in compliance with backup and disaster recovery times.

For greater transparency, we indicate below the data retention periods related to the main purposes expressed above:

  • contractual compliance: may be retained for the entire duration of the contract, as well as for the subsequent mandatory retention period by law;
  • marketing (including newsletter sending): may be retained for a maximum of two years, unless consent is revoked by the data subject; furthermore, such data may be deleted if the user does not show interest in our services or our communications (e.g., the user does not open our newsletters for a certain period of time established by the Data Controller);
  • profiling: may be retained for a maximum of two years, unless consent is revoked by the data subject, which can be done through the cookie settings as indicated in the cookie policy;
  • ascertainment, exercise or defense of a right (also in court), may be retained until the resolution of the dispute.

How are personal data processed?

Data processing takes place both through our website and through other electronic tools, or with paper means, applying the security measures provided for by the legislation referred to in European Regulation 2016/679.  

Gensan s.r.l. uses technologies, security measures, rules and other procedures (e.g., minimization and pseudonymization) to protect users' personal data from unauthorized access, misuse, dissemination, loss or destruction in accordance with the provisions of Articles 25-32 of European Regulation 2016/679. To ensure data confidentiality, Gensan s.r.l. uses firewalls and password protection systems compliant with industry standards, electronic or paper tools. 

 

What rights does the data subject have?

You can exercise the rights provided for in CHAPTER III of European Regulation 2016/679 at any time. In particular, you have the right to ask the Data Controller for access to your data, their rectification or erasure, the integration of incomplete data, the restriction of processing; to receive the provided data in a structured, commonly used and machine-readable format; to revoke any consent given relating to processing and to object in whole or in part to the use of the data; as well as to exercise the other rights recognized by the applicable regulations.

How to exercise your rights?

To exercise your rights or request more information, you can contact the data controller at info@gensan.com. If you believe that the processing of personal data occurs in violation of the provisions of European Regulation 2016/679, you have the right to lodge a complaint with the Garante, as provided for by Article 77 of the Regulation itself, or to seek appropriate judicial remedies (Article 79 of European Regulation 2016/679).
