Information pursuant to art. 13 of European Regulation 2016/679 for newsletter subscription
Articles 13 and 14 of European Regulation 2016/679
1) Data Controller

- VAT no. 01312580507), in the person of its Managing Director Dr. Edoardo Di Martino.
2) Data Protection Officer

3) Type of data
With your consent, Gensan s.r.l. may process your personal data (personal details, contact details and optionally provided data relating to purchase preferences).
4) Purpose of processing
The processing of your personal data will be carried out to send you newsletters or promotional communications and exclusive events reserved for Gensan s.r.l. Customers.
These marketing activities may be carried out via email, digital platforms, or by sharing your personal data with digital platforms and social networks, as part of campaigns such as "Custom Audience CRM". In this way, you may find Gensan s.r.l. advertisements in the spaces on the pages of digital platforms.
5) Legal Basis
The legal basis for this purpose is art. 6.1, letter a of European Regulation 2016/679, i.e., your consent.
You may revoke your previously given consent at any time by writing to info@gensan.com.
Data may also be processed, even without the consent of the data subject, for legal obligations pursuant to art. 6.1, letter c) of European Regulation 2016/679 or to ascertain, exercise or defend a right in court, pursuant to art. 9.2, letter f) of European Regulation 2016/679.
6) Communication and processing of data
Personal data relating to the processing in question may be processed by employees who work at and for Gensan s.r.l., in their capacity as data processors and/or system administrators, or by third-party companies that perform activities in the name and on behalf of the Data Controller, in their capacity as external data processors, pursuant to art. 28 of European Regulation no. 679/2016.
Furthermore, such data may in any case be communicated to subjects entitled to request them, such as the Judicial Authority. The personal data in question are not subject to further communication and/or dissemination, with the exception of the subjects indicated above.
7) Mandatory/optional nature of data provision
The provision of personal data relating to the processing is optional; however, failure to provide it will make it impossible for Gensan s.r.l. to pursue the purpose referred to in point 4.
8) Transfer of data to Third Countries or International Organizations
For sending newsletters, the MailChimp platform is used, which is managed by The Rocket Science Group LLC, based in the State of Georgia, to which we transfer your personal data for this purpose (sub 4).
The lawfulness condition for the transfer is constituted by art. 46, second paragraph, letter c) of European Regulation 2016/679 (standard contractual clauses). Further information is available at the following link: https://mailchimp.com/legal/data-processing-addendum/.
Personal data may be communicated to third parties, even outside the European Union, through the use of transfer mechanisms deemed suitable by Chapter V of European Regulation 2016/679.
9) Processing methods
Processing may be carried out with or without the aid of electronic or otherwise automated means, using technologies, security measures, rules and other procedures (e.g., minimization and pseudonymization) to protect your personal data from unauthorized access, misuse, disclosure, loss or destruction, in compliance with personal data processing regulations, including applicable provisions and authorizations issued by the Garante (Italian Data Protection Authority).
10) Retention period
Personal data may be stored for a maximum of two years, unless the data subject revokes consent; furthermore, such data may be deleted if the user does not show interest in our services or communications (e.g., the user does not open our newsletters for a certain period of time set by the Controller);
11) Rights of data subjects
Pursuant to articles 15, 16, 17, 18, 20 and 21 of European Regulation 2016/679, the data subject has the right to request from the Data Controller access to personal data and the rectification or erasure thereof or the restriction of processing concerning them or to object to their processing. 12) Right to complain
The data subject has the right to lodge a complaint with the Garante, as provided for by art. 77 of the Regulation itself, or to seek recourse through the appropriate judicial channels (art. 79 of European Regulation 2016/679), if they believe that the processing of personal data is carried out in violation of the provisions of European Regulation 2016/679.
